Regulations for making donations through magis2024.eu portal

§1 Definitions

  1. Portal – i.e. the website with all its functionalities, i.e. magis2024.eu
  2. Organization – Service Provider within the meaning of the Act of 18 July 2002 on the provision of services by electronic means – the Society of Jesus, Province of Southern Poland, REGON: 040020141, NIP: 6761174202, accepting donations made by traditional transfer and using the services of a Payment Operator for statutory purposes.
  3. Regulations – these Regulations.
  4. User – any entity that uses the services offered through the Portal.
  5. Payment Operator – PayPal / PayU
  6. Traditional transfer – a transfer made from the Donor’s bank account to the Organization’s bank account, without the intermediation of the Payment Operator.
  7. Donation – funds donated by the User for the purposes of the Organization.
  8. Donor – an adult natural person, legal entity or organizational unit that makes a donation to the Organization through the Portal using the services of the Payment Operator or by making a traditional transfer.

§2 General provisions

  1. The purpose of these Regulations is to set out the rules for the provision of electronic services by the Organization, which consists in enabling persons using the Portal to make monetary donations for the activities of the Organization.
  2. The provisions of these Regulations shall also apply to donations made by traditional transfer.
  3. The Portal is used to raise funds for the purposes of the Organization and to conduct communication with Donors and other Users.
  4. Each Donor agrees to be communicated with by email or correspondence in order to inform about the progress of the collection and to inform about the activities of the Organization, which consent may be revoked at any time, which will be equivalent to resignation from receiving communications from the Organization.
  5. The User is required to read the Regulations before using the Portal, and use of the Portal is tantamount to acceptance of the contents of the Regulations.
  6. The User is obliged to comply with the provisions of the Regulations. The Organization shall make the Regulations available to the Users prior to the conclusion of an agreement for the provision of services by electronic means (by which it is understood that the possibility of using the Portal is made available) by placing them on the website in such a way that everyone has access to them at a place and time of their own choosing and can download and save them in an electronic version. Access to the Terms and Conditions may require the User to have hardware and software with certain settings (e.g. software to read doc., docx, pdf. format).

§3 Donation, or transfer of funds

  1. By transferring funds, the User is making a donation, i.e. a legal act regulated by Article 888 of the Civil Code. This agreement involves the transfer of the User’s assets to the recipient under the title of donation and is concluded at the time of receipt of the donation by the Organization.
  2. The transfer of funds results in the fulfillment of the prerequisites of Article 890 §1 second sentence of the Civil Code, which means that regardless of the failure to observe the written form, the donation is valid and effective.

§4 Technical requirements

  1. For effective provision of services through the Portal, the User should meet the following requirements:

    • possession of a device that allows access to the Internet and access to the Internet,
    • using a web browser with settings that allow for proper display of the website and that accepts cookies,
    • having an active electronic address.
  2. If fees are associated with meeting the technical requirements referred to in the preceding paragraph, they shall be charged to the User.

 §5 Conclusion of the donation agreement

  1. The agreement shall be concluded when the User starts using the functionality of the Portal.
  2. In order to execute the agreement, it may be necessary for the User to have an account with the Payment Provider.
  3. The conclusion of the agreement is voluntary.
  4. The Organization, through the Portal and on the basis of these Regulations, provides a service that consists in enabling – using the Payment Operator – to make a donation to the Organization.
  5. The Organization shall not charge commissions or additional fees to Users, which does not exclude the possibility of charging them by the Payment Operator.
  6. The provision of the service referred to in § 5.4 of these Regulations does not exclude making a donation in the form of a traditional transfer, without the intermediation of the Payment Operator.

§6 Personal data protection

  1. The administrator of Users’ personal data is the Organization. Provision of personal data is fully voluntary, but necessary for the use of all functionalities of the Portal, especially for the implementation of the donation.
  2. In matters relating to personal data, the Organization should be contacted via e-mail address: [email protected]. Personal data are processed for the following purposes:
    • handling the donation process,
    • contact to inform about the progress of the collection and to send thanks (in the form of traditional or electronic correspondence).
  3. The legal basis for the processing of personal data is Article 6(1)(b), (c) and (f) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RODO).
  4. The following data shall be processed:
    • first name, last name and electronic address of the User, provided by the Financial Intermediation Service to the Service Provider in connection with the payment of the Donation amount to the Service Provider’s account;
    • address data (if provided by the User).
  5. Users’ personal data will not be transferred outside the European Economic Area.
  6. Users’ personal data will be kept for a period of 5 years, but may be kept longer if justified for protection in the field of claims.
  7. Users have the right to access their personal data, to rectify, delete or change the scope (limitation) of processing, as well as to withdraw their consent to processing. Withdrawal of consent and request for deletion of data may be submitted to the electronic address: [email protected].
  8. Withdrawal of consent and request for deletion of data shall mean termination of the contract for electronic services concluded between the User and the Organization. In the event of a request for deletion of data or withdrawal of consent to their processing, the Organization is obliged to immediately comply with the request.
  9. The Administrator shall not process the data in an automated manner or conduct profiling.
  10. The User has the right to lodge a complaint to the supervisory authority, which is the President of the Data Protection Authority, with its seat: 2 Stawki Street, 00-193 Warsaw.

§7 Complaints

  1. The User has the right to file a complaint at the electronic address: [email protected].
  2. The Organization shall, no later than within 14 days, respond to the complaint by replying to the address from which the complaint was sent.
  3. The Organization reserves the right to leave the complaint unprocessed if the complaint is submitted after the time limit indicated in the Civil Code, or if it is due to ignorance of the provisions of these Regulations.

§8 Amendments to the Regulations

  1. The Organization has the right to make changes to the Regulations.
  2. Users will be informed of changes to the Terms and Conditions at least 14 days before the changes are made by posting a notice on the Portal.

§9 Final provisions

  1. The Rules and Regulations are effective from the date of their publication on the Portal, subject to §8.
  2. The Regulations are intended to ensure harmonious cooperation between the Users and the Organization, therefore each User has the right to submit comments and questions to it, to the electronic address [email protected].
  3. The Regulations shall come into force on 14.12.2023.
